Complaint

Global Estonia gives no contract: nothing in writing, no breakdown, no clear counterparty

Reported by: R. N. · From the start · ★★☆☆☆

Last updated:

In the reported cases the service was sold by e-mail; no signed service agreement, price list or delivery commitment is provided. Which legal entity is responsible for which service can only be read off the invoice. With no document to rely on in a fee dispute, every discussion ends at “this is how we calculate”. For a corporate customer, who is not a consumer under Estonian law, the lack of a written contract also makes the claim harder to prove.

(Opinion: a provider without a written contract has no enforceable obligation towards you either; when you object it can simply ignore you, and in the reported cases that is exactly what it did. One should not work with such a company.)

This card describes a complaint type rather than one incident; details may vary from report to report.

Evidence: Dated e-mails, invoices and payment records are kept on file; they are not published here to protect identities, and are shared with the authorities and with the company under the right of reply.

How to recognise this situation

  • Payment is requested by quote e-mail and invoice; there is nothing to sign.
  • The terms of service are not written in one place.
  • Which company is responsible does not appear on any document.

Questions to ask the provider

  • Can you send a signed contract covering scope, term, price and termination?
  • Which company is the contracting party?
  • If you have general terms, which version applies to this service?

What to do about this type of complaint

Before paying in advance, ask for scope, term, refund and termination terms in one written document; invoices and e-mails are not a contract. Know that you can change the contact person and legal address in the register yourself when needed; get the exit plan in writing at the start.
