Terms that are not in writing

Complaints of this type share one gap: the terms of the service are not in a single written document. In the reported cases payment is requested by quote e-mail and invoice; scope, delivery date, refund and termination terms are not written. The invoicing company can change from period to period; according to the provider’s website, accounting is compulsory and the address package is non-refundable once the term starts. When a problem arises the customer does not know what to rely on, and leaving raises returning the documents and transferring the contact person. What should be in writing before paying in advance is listed point by point in the guide to choosing an accountant. (Opinion: in a relationship without written terms, the seller has the last word in any dispute.)

What to do about this type of complaint

Before paying in advance, ask for scope, term, refund and termination terms in one written document; invoices and e-mails are not a contract. Know that you can change the contact person and legal address in the register yourself when needed; get the exit plan in writing at the start.

Frequently asked questions

I paid without a contract; what can I do?

The quote e-mail, the invoice and the payment receipt together prove the agreement. State what was not delivered and your refund request in one written formal notice; if you paid by card, you can dispute the charge with your bank. Details in the complaints guide.

Can I change the contact person without the provider’s consent?

Yes. The contact-person entry is changed in the company portal with the new contact person’s consent; the old contact person’s consent is not needed. Steps in the guide to filing your own report.

What if my documents stay with the provider?

Accounting documents belong to your company, and keeping them for seven years is the company’s duty. Request them in writing with a list; you can also get bank statements from the bank, returns from e-MTA and annual reports from ariregister yourself.
